Terms & Conditions

Last updated 12 October 2026

These are the terms for using Matus. We have kept them as plain as we can.

1. About these terms

These terms apply to your use of the Matus website and platform. By creating an account or using the platform, you agree to them. If you are signing up for a business, you confirm you have authority to accept these terms on its behalf.

2. Your account

  • Give us accurate details when you sign up and keep them up to date.
  • Keep your password private. You are responsible for what happens under your account and for the team members you invite.
  • Tell us straight away if you think someone has accessed your account without permission.

3. Free trial and billing

  • Paid plans start with a 7-day free trial. We ask for your card details when you sign up, and you are not charged during the trial.
  • Unless you cancel before the trial ends, your first payment is taken at the end of day 7 and your plan then renews each month until you cancel.
  • Prices are in Australian dollars. We will tell you in advance if the price of your plan is going to change.
  • Some usage, such as text messages, calls, emails and AI features, may be charged in addition to your plan at the rates shown in your account.
  • Payments are processed by Stripe. If a payment fails, we may pause your account until it is resolved.

4. Cancelling

You can cancel at any time by emailing admin@earngmedia.com. Your plan stays active until the end of the period you have paid for. Except where the law requires otherwise, payments already made are not refunded.

5. Using the platform responsibly

You agree not to use the platform to:

  • Send messages to people who have not agreed to hear from you, or otherwise breach spam, telemarketing or privacy laws, including the Spam Act 2003 (Cth).
  • Send content that is unlawful, misleading, harassing or harmful.
  • Interfere with the platform, try to access other customers' data, or get around security or usage limits.
  • Resell or share access to the platform without our written agreement.

6. Your data

The information you and your customers put into your account remains yours. You give us permission to store and process it so we can provide the platform. You are responsible for having the right to collect that information and to contact the people in your account. Our Privacy Policy explains how we handle personal information.

7. AI features

The platform includes AI agents and an AI support assistant. AI-generated replies can be wrong or incomplete. You are responsible for how you set up your agents and for checking that what they say to your customers is accurate and appropriate.

8. Third-party services

The platform connects to services run by other companies, such as phone and email carriers, calendars, social networks and payment providers. Those services have their own terms, and we are not responsible for their availability or actions.

9. Our intellectual property

We and our licensors own the platform, the Matus name and our website content. You may use them only as needed to use the platform under these terms.

10. Availability and changes

We work to keep the platform available and reliable, but we do not promise it will be uninterrupted or error-free. We may change or remove features from time to time, and we will give reasonable notice of changes that materially affect you.

11. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Subject to those rights, we are not liable for indirect or consequential loss, including lost profits or lost data, and our total liability to you is limited to the fees you paid us in the 12 months before the claim arose.

12. Suspension and termination

We may suspend or close your account if you breach these terms, do not pay, or use the platform in a way that puts us or others at risk. When an account closes, you can ask us for a copy of your data within 30 days, after which it may be deleted.

13. Changes to these terms

We may update these terms from time to time. If a change is significant we will let you know by email or in your account. Continuing to use the platform after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction over any dispute.
